1Week 2 – Legal ComplianceThis week we cover the laws and regulation that impact staffing. Employers cannot basestaffing decisions on: age, race, national origin, religion, color, or sex. Many states havepassed additional laws that prohibit the employer from considering the followingcharacteristics physical handicap; sexual preference and some states are consideringprohibiting employers from considering an applicant’s height or weight.Another way of identifying factors that cannot be considered in the section process is tothink of what characteristics about a person cannot be changed. These characteristics thatcannot (easily) be changed are referred to as “immutable characteristics.” We cannoteasily change our height or gender. So, one can better understand if selection decisionscould be based on factors that could not be changed, there could be a significant amountof discrimination and consequent unemployment. Therefore our government serves theelectorate by passing laws that prohibit unfavorable or bias treatment.This week’s lecture is supplemented with websites.A word of caution do, not be surprised or dismayed with you employer with co-workersor Human Resource professionals who utilize prohibited question or non-job relatedsection criteria. Although the laws prohibiting inquiries into age, race, gender, etc hadexisted for 30+ years, it is very difficult for some people to give up their favoriteinterview questions. When we encounter these situations, we work with the person to findacceptable legal alternatives.
