Question: Jim needs money. He goes to his 85-year-old mother’s home and requests that she loan him $100 dollars. She refuses because he has not repaid the prior loans. Jim then files suit in civil court requesting that the court declare his mother no longer competent to handle her financial affairs and to appoint him as guardian of his mother’s funds. He presents evidence that his mother frequently forgets to pay the phone and water bills, and that several times those items have been disconnected for non-payment. An older person can be described as someone who is at least over 60 years old. Abuse of the elderly is the act, either single or repeated, or failure to act appropriately, that occurs within any relationship where trust is a major factor, which leads to or causes an older person to be in distress or suffer harm. This harm is caused by people known to the older person and with whom he has a relationship with, for example, spouses, family, family friends, neighbors, or someone entrusted to provide service to the older person. Elder abuse is recognized as domestic violence (Bows & Penhale, 2018).
There are several types of elder abuse, and the common ones include Physical abuse. This is the causing of pain, illness, or injury to an older person by the intentional use of physical force. It may include hitting, kicking, slapping, pushing, confinement and false imprisonment, restraining and burning, and withholding medication or treatment. Sexual abuse is forcing older people to take part in sexual activities without their consent. This may involve forcing them into conversations of a sexual nature, sexual contact or penetration, or acts such as sexual harassment, which are generally non-contact. Psychological or emotional abuse. These are the verbal and non-verbal behaviors that inflict mental pain, fear, anguish, or distress on an older person ( Ballard, 2016).
Mostly the abuser identifies that which is important to an elderly person and manipulates it to coerce the elderly individual into doing what they want; it may take verbal forms such as name-calling, yelling, constant criticism, ridiculing, blaming. It may also be nonverbal such as silence, shunning, or ignoring. Financial abuse. It involves the misusing of finances by the members of the family, caregivers. It can also involve using finances to manipulate the elder or cause some other form of abuse. It can also involve failure to support the elderly financially in countries where it is provided for.
Signs of abuse of the elderly vary according to the type of abuse the older person is experiencing. Physical abuse detection can be through identifying, scars, bruises and sprains or broken bones on the body and maybe signs of restraint. Emotional abuse, which often accompanies the other types of abuse, can be recognized through behavioral or personality changes in the person. Financial abuse, which is more subtle and maybe challenging to notice, the signs would include significant withdrawal from accounts, numerous unpaid debts to the older person, missing household belongings and money, unpaid bills, and unnecessary purchases (Cliff & O’Reilley,2019). Signs of sexual abuse may be visible on the body, mostly around the person’s genitalia and breasts, additional signs include mysterious infections, bleeding, and torn undergarments. Neglect can be seen through poor hygiene, bad eating habits, not taking medication, dehydration, and living in unhygienic conditions.
Jim’s treatment of his elderly mother can be said to be a form of financial elder abuse. His refusal to pay back all the monies he owes to the mother is an abuse of the relationship they share, and he is taking advantage of the fact that the mother is elderly not to pay it back. Since the mother has refused to loan him the money, he manipulates the late payment and sometimes non-payment of the elderly mother’s bill to try to make a case for the mothers incompetence to take care of herself so that he can be made the guardian of the mothers’ finances so that he can do with them as he pleases.
