The drone delivery business has been on the increase. However, businesses like X, Inc. that engage in this kind of business face several legal issues. One such issue pertains to tort law, and in particular, tort of trespass. Currently, the law states that residential airspace is trespassed when flying vehicles that are unauthorized fly under four-hundred feet above a property. Therefore, legal issues may arise if the company’s drones fly under 400 feet beneath the property of customers’ neighbors. Another legal issue relates to privacy law. Again, if the company’s drones fly over a person’s private property and the individual has not given their consent to a drone delivery, X, Inc. may be sued for violating the person’s privacy rights.
Patent law is yet another legal issue. This law seeks to protect new inventions. Conventional patents safeguard scientific inventions that are tangible; examples of such inventions include vehicle engines, circuit boards, zippers or heating coils (Meiners, Ringleb & Edwards, 2016). Nonetheless, with time, patents have been utilized to safeguard a wider variety of inventions like business practices, coding algorithms etc. In this regard, a good example is where the company invents techniques for transferring goods from the air to the ground. Criminal law is a legal issue that the company could encounter as well. The FAA Modernization and Reform Act (FMRA) was passed by Congress in the year 2012. As such, the Act requires Federal Aviation Administration (FAA) to incorporate drones into the national airspace system, and drones should thus be registered with the FAA. Therefore, failure of X, Inc to register with FAA may result in criminal penalties of up to 250,000 dollars or 3 years imprisonment. Environmental law is the last issue. In this case, X, Inc may be accused of noise pollution as their drones travel to different areas to deliver products.
